TR KVKK Aydınlatma Metni

1. Veri Sorumlusunun Kimliği

PostPolitik olarak (Bundan böyle "Veri Sorumlusu" olarak anılacaktır), kişisel verilerinizi 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") ve ilgili sair mevzuata uygun olarak belirli sınırlar içerisinde toplamakta ve işliyoruz.

2. İşlenen Kişisel Verileriniz

Uygulamamız üzerinden kayıt formunu doldurarak yahut Sosyal Medya üzerinden sisteme giriş yaparak otomatik olarak aktardığınız ve uygulamayı kullandığınız süre zarfında işlenen verileriniz şu şekildedir:

Kimlik ve İletişim: Ad, Soyad, Kurumsal veya bireysel E-posta adresi.
Görsel Veriler: Platform üzerindeki tasarımlara (tebrik, kutlama şablonlarına) kendi iradeniz ile eklediğiniz "profil ve dekupe fotoğraflarınız".
Özel Nitelikli Veri Beyanı (Siyasi Düşünce): ÖNEMLİ: Sistemimiz, çeşitli siyasi partilere özgü şablonlar barındırmaktadır. Seçtiğiniz şablonlar profilinize entegre olduğundan yasanın Madde 6 fıkrası uyarınca "Siyasi Düşünce" kategorisindeki özel nitelikli kişisel veriyi oluşturabilir. Bu veriler sadece ve sadece giriş anında tarafınızca dijital olarak onaylanan Açık Rıza Sözleşmesine istinaden şablon giydirme işlemi için işlenir.

3. Verilerin İşlenme Amacı ve Hukuki Sebebi

Kişisel verileriniz, KVKK 5. Maddenin 2. fıkrası "Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması" ile 6. Maddede yer alan "Açık Rıza" hukuki işlemlerine dayanılarak şu amaçlarla işlenmektedir:

Platform üzerinden kendi kurumsal kimliğinize ait dijital tasarımlar üretmek.
Sisteme bağladığınız X ve Facebook platformlarına resmi API servislerini kullanarak gönderim yapıp komutlarınızı gerçekleştirmek.
Teknik hizmet sorunlarınızı yönetmek ve kullanım limitlerinizi (Abonelik, Token kotası vb.) kontrol etmek.

4. Verilerin Aktarılabileceği Kişi / Kuruluşlar

Verileriniz ticari hedefleme veya üçüncü taraf firmalara para karşılığı asla satılmaz. Sadece kendi öz iradenizle paylaş butonuna bastığınızda, ürettiğiniz ilgili içerikler (Sözleşme ifası kapsamında) X Corp. (Eski Twitter), Meta Platforms Inc. (Facebook/Instagram) bünyesindeki sunuculara görsel/metin formatında aktarılır.

Bunun yanı sıra adli makamlardan gelen resmi mahkeme kararlarına istinaden hukuki süreçlerde IP ve Login kayıtları devlet makamlarıyla paylaşılabilecektir.

5. KVKK Madde 11 Uyarınca İlgili Kişi Hakları

KVKK 11. Maddesi çerçevesinde aşağıdaki haklara sahipsiniz:

Kişisel veri işlenip işlenmediğini öğrenme, işlenmişse bilgi talep etme,
İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,
Eksik veya yanlış işlenen verilerin düzeltilmesini talep etme,
Bağlı bulunan şartlar sağlandığında "Verilerin Silinmesi"ni ("Unutulma Hakkı") talep etme.

Yukarıdaki haklarınızı kullanmak ve tüm taleplerinizi iletmek için bilgi@postpolitik.com e-posta adresi üzerinden elektronik yolla başvuruda bulunabilirsiniz. Başvurunuz sistemde kayıtlı bulunan e-postanız üzerinden yapıldığı takdirde, en geç 30 (otuz) gün içerisinde ücretsiz olarak sonuçlandırılacaktır.

1. Identity of the Data Controller

As PostPolitik (Hereinafter referred to as the "Data Controller"), we collect and process your personal data within specific limits in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK" / Turkish GDPR Equivalent) and other relevant legislation.

2. Your Processed Personal Data

The personal data that is automatically transferred when you fill out the registration form via our application or log into the system via Social Media, and which is processed during the time you use the application, is as follows:

Identity and Contact: Name, Surname, Corporate or individual Email address.
Visual Data: Your "profile and cut-out photos" that you add to the designs (greeting, celebration templates) on the platform of your own free will.
Declaration of Special Category Data (Political Opinion): IMPORTANT: Our system contains templates specific to various political parties. Since the templates you choose are integrated into your profile, this may constitute sensitive personal data in the "Political Opinion" category in accordance with Article 6 of the law. This data is processed only and exclusively for the template application process, based on the Explicit Consent Agreement you digitally approve upon login.

3. Purpose and Legal Reason for Processing Data

Your personal data is processed for the following purposes based on the legal actions of Article 5, paragraph 2 of the KVKK "It is necessary for the processing of personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract" and "Explicit Consent" under Article 6:

To produce digital designs belonging to your corporate identity over the platform.
To execute your commands by sending them to the X and Facebook platforms you connected to the system using their official API services.
To manage your technical service issues and to control your usage limits (Subscription, Token quota, etc.).

4. Persons / Organizations to Whom Data Can Be Transferred

Your data is never sold for financial gain to commercial targeting or third-party companies. Only when you press the share button of your own free will, the relevant content you produce (within the scope of contract performance) is transferred to servers within X Corp. (Formerly Twitter), Meta Platforms Inc. (Facebook/Instagram) in visual/text format.

In addition, based on official court decisions from judicial authorities, IP and Login records may be shared with state authorities in legal processes.

5. Rights of the Data Subject Pursuant to Article 11 of KVKK

Within the framework of Article 11 of the KVKK, you have the following rights:

To learn whether personal data is processed and, if so, to request information regarding it,
To learn the purpose of processing and whether they are used appropriately for their purpose,
To request the correction of incompletely or incorrectly processed data,
To request the "Deletion of Data" ("Right to be Forgotten") when the required conditions are met.

You can apply electronically via the bilgi@postpolitik.com e-mail address to exercise your rights above and to forward all your requests. If your application is made via your e-mail registered in the system, it will be concluded free of charge within 30 (thirty) days at the latest.
