TR Kullanım Koşulları

1. Sözleşmenin Kabulü ve Başlangıç

PostPolitik ("Uygulama" veya "Platform"), kullanıcılara (Bireysel veya Kurumsal) siyasal iletişim stratejileri kapsamında tasarımlar üretme, metin içeriklerini yapay zeka ile zenginleştirme veya şablonlama hizmeti sunmaktadır. Bu internet sitesini ziyaret ederek veya bir hesap oluşturarak, işbu hizmet kullanım koşullarını şartsız olarak kabul etmiş sayılırsınız. Kurallara veya kanunlara uyulmadığı takdirde PostPolitik, üyeliğinizi tek taraflı olarak feshetme hakkına sahiptir.

2. Mülkiyet ve Telif Hakları

Platformda sunulan tüm genel şablonlar, görseller, çerçeveler ve akıllı algoritmik yazılım kodlarının ("Platform İçeriği") telif hakları doğrudan tarafımıza (PostPolitik) veya ilgili lisans sahiplerine aittir. Kullanıcılar, hesaba bağlı abonelikleri devam ettiği sürece uygulamanın çıktısı olan PNG/JPEG gibi nihai görselleri sosyal medya platformlarında diledikleri gibi yayınlayabilir, çoğaltabilir. Ancak PostPolitik altyapısının doğrudan (şablon kodları vs.) tersine mühendisliği (reverse-engineering) kesinlikle yasaktır.

3. İçerik ve Kullanıcı Sorumlulukları

Platform içerisinden API kullanarak (veya dolaylı yönden görsel indirip sonradan atarak) kendi sosyal medyanıza gönderdiğiniz her türlü yorum, görüş ve ifadeden (Siyasi söylem, hakaret, yasa dışı bildirim vb.) birebir ilgili kullanıcı sorumludur.

Yazılım, sizin ürettiğiniz içerikleri veya eklediğiniz fotoğrafları önceden bir "yayın editörü" mantığıyla editoryal ve hukuki süzgeçten (ön kontrolden) geçirmez.
Siyasi partilerin tüzel kişiliklerine, rakiplere veya 3. şahıslara karşı yapılabilecek potansiyel TCK ihlali eylemlerinde (hakaret, iftira, karalama kampanyası) PostPolitik hiçbir hukuki (adli veya idari) sorumluluk kabul etmez.
Platform üzerinden üretilen yapay zeka destekli metinler "tavsiye" niteliğindedir. Yayınlanmadan önce mutlaka doğruluğu kullanıcı tarafından teyit edilmelidir.

4. Kurumsal Kimlik ve İtibarın Korunması

Kullanıcı, PostPolitik platformu üzerinden içerik üretirken, temsil ettiği veya üyesi olduğu siyasi partinin Kurumsal Kimlik Kılavuzu, parti tüzüğü ve genel etik değerlerine sadık kalacağını beyan ve taahhüt eder.
Platformun sunduğu logo, kurumsal renk, tipografi ve tasarım şablonlarının; partinin resmi görüşlerine aykırı, manipülatif, aşağılayıcı veya kurumsal bütünlüğü zedeleyici şekilde kullanılması kesinlikle yasaktır.
Kullanıcı; halkı kin ve düşmanlığa tahrik eden, parti disiplinine aykırı veya temsil ettiği makamın ağırlığıyla bağdaşmayan içerikler üretmesi durumunda oluşacak her türlü hukuki, cezai ve siyasi sorumluluğun bizzat kendisine ait olduğunu kabul eder.
PostPolitik, kurumsal kimliğe zarar verdiği tespit edilen kullanıcının hesabını (bildirimsiz olarak) askıya alma veya tamamen kapatma hakkını saklı tutar.

5. Meta ve X (Twitter) Platform Kuralları (Hizmet İlkeleri)

Kullanıcı, PostPolitik üzerinden yayın yaparken aynı anda Meta (Facebook & Instagram Terms of Service) ve X Platform (Developer Agreement & Policy) kurallarını da peşinen kabul ettiğini taahhüt eder. API yoluyla manipülatif bot faaliyetleri (Spamming), yalan haber yayılımları veya yapay etkileşim hileleri gerçekleştirmeyeceğini tahhüt eder.

6. Hizmetin Kullanılabilirliği (Uptime) ve Garanti

Yazılım ekibimiz, sunucuların %99.9 oranında UP (Aktif) kalması ve platformdan sorunsuz istifade etmeniz için uğraş vermektedir. Ancak bakım veya sürüm güncellemesi (maintenance) durumlarında servis geçici bir süreliğine kapatılabilir. Sunucu barındırma altyapısının ya da Facebook, X gibi harici platformların sistem sorunlarından kaynaklanan paylaşım API kesintilerinde platformumuz garanti sunmamaktadır.

7. Abonelik ve İade

Satın alınan dijital servis ve abonelik sürelerinde, sistem kaynaklı çalışamama problemi (uzun süreli teknik arıza) gibi istisnai gerekçeler ispatlanamadığı sürece, Dijital Hizmetler Kanununa göre kullanım başlatıldığından iade prosedürü bulunmamaktadır. Yenilemeler iptal edilene kadar sürer.

8. Yasal Başvuru

Tüm ihtilafların ve uyuşmazlıkların çözümünde öncelikle Türkiye Cumhuriyeti yasaları uygulanacak olup, platform adresimizin bağlı bulunduğu yetkili mahkemeler (İstanbul/Ankara Mahkemeleri) görevlidir.

EN Terms of Service

1. Acceptance of Terms and Induction

PostPolitik ("Application" or "Platform") provides services to users (Individual or Corporate) within the scope of political communication strategies to produce designs, enrich text content with artificial intelligence, or provide templating services. By visiting this website or creating an account, you unconditionally accept these terms of service. PostPolitik reserves the right to unilaterally terminate your membership in case of non-compliance with the rules or laws.

2. Ownership and Copyrights

The copyrights of all general templates, visuals, frames, and smart algorithmic software codes ("Platform Content") offered on the platform belong directly to us (PostPolitik) or the respective license holders. Users may publish and reproduce the final visuals (such as PNG/JPEG) output by the application on social media platforms as they wish, as long as their subscription attached to the account continues. However, direct reverse-engineering of the PostPolitik infrastructure (template codes, etc.) is strictly prohibited.

3. Content and User Responsibilities

The relevant user is individually responsible for any kind of comment, opinion, and expression (Political discourse, insult, illegal notification, etc.) sent to their own social media via API from within the platform (or indirectly by downloading the visual and posting it later).

The software does not put the content you produce or the photos you add through a "publishing editor" logic, meaning an editorial and legal filter (pre-check) before publishing.
PostPolitik assumes no legal (judicial or administrative) liability for potential TCK (Turkish Penal Code) violation actions (insult, slander, smear campaign) that may be directed against the legal entities of political parties, competitors, or 3rd parties.
The AI-supported texts produced over the platform are of a "recommendation" nature. Their accuracy must absolutely be verified by the user before publishing.

4. Protection of Corporate Identity and Reputation

The user declares and commits to adhere to the Corporate Identity Guide (Brand Book), party bylaws, and general ethical values of the political party they represent or are a member of while producing content via the PostPolitik platform.
It is strictly forbidden to use the logos, corporate colors, typography, and design templates provided by the platform in a manipulative or degrading manner, or in a way that contradicts the party's official views and damages its corporate integrity.
The user accepts that all legal, criminal, and political responsibility rests entirely with them in the event that they produce content that incites public hatred and hostility, violates party discipline, or is incompatible with the gravity of their office.
PostPolitik reserves the right to suspend or permanently close the account of any user (without prior notice) who is found to have damaged the corporate identity.

5. Meta and X (Twitter) Platform Rules (Terms of Service)

The user, while broadcasting via PostPolitik, commits to accepting the Meta (Facebook & Instagram Terms of Service) and X Platform (Developer Agreement & Policy) rules in advance. The user pledges not to perform manipulative bot activities (Spamming), spread fake news, or engage in artificial interaction cheats via API.

6. Service Availability (Uptime) and Warranty

Our software team strives to keep our servers UP (Active) at 99.9% and to ensure you benefit smoothly from the platform. However, the service may be temporarily closed in cases of maintenance or version updates. Our platform does not provide a warranty for sharing API interruptions caused by server hosting infrastructure or system issues of external platforms like Facebook, X.

7. Subscription and Refund

For purchased digital services and subscription periods, unless an exceptional reason such as a system-sourced operational problem (long-term technical failure) can be proven, there is no refund procedure since the use has started, according to the Digital Services Act. Renewals continue until canceled.

8. Legal Jurisdiction

In the resolution of all disputes and conflicts, the laws of the Republic of Turkey shall be applied primarily, and the authorized courts (Istanbul/Ankara Courts) where our platform's address is affiliated have jurisdiction.
